This Notice describes how medical information about you may be used and disclosed, how you can get access to this information, and the privacy rights available to you.

Your Rights
You have certain rights regarding your health information. You may:

Request a paper or electronic copy of your medical record.

Getting a Copy of Your Health Information
You may request a copy of the health information we maintain about you in paper or electronic form. We will generally provide a copy or summary within the timeframe required by applicable law. We may charge a reasonable, cost-based fee when permitted by law.
Correcting Your Health Information
You may ask us to correct information in your medical record that you believe is incorrect or incomplete. We may deny certain requests when permitted by law. If a request is denied, we will explain the reason as required by law.
Confidential Communications
You may ask us to contact you in a specific way, such as by phone, text, email, or mail, or to use a different address or phone number. We will accommodate reasonable requests as required by law.
Requests to Limit Uses or Disclosures
You may ask us not to use or disclose certain health information for treatment, payment, or healthcare operations.
We are not always required to agree to these requests. When you pay for a healthcare service or item completely out of pocket, you may ask us not to disclose information about that service or item to your health plan for payment or healthcare operations. We will honor such requests when required by law unless disclosure is otherwise required by law.
Accounting of Disclosures
You may request an accounting of certain disclosures of your health information made during the six years before your request. Certain disclosures are excluded from an accounting under applicable law, including many disclosures for treatment, payment, and healthcare operations. We will provide one accounting during a 12-month period without charge. Additional requests may be subject to a reasonable, cost-based fee when permitted by law.
Someone Acting on Your Behalf
If another person has legal authority to act on your behalf, such as a legal guardian, healthcare power of attorney, or other authorized personal representative, that individual may exercise applicable privacy rights on your behalf. We may verify that person's authority before taking action.
Your Choices
For certain health information, you may tell us your preferences about what we share.
Where applicable, you may tell us whether and how we may:

Share information with family members, friends, caregivers, or others involved in your care.

Share information in a disaster-relief situation.

Communicate with you regarding certain marketing activities.

Use or disclose information for purposes requiring your authorization.
If you are unable to communicate your preference, we may share information when permitted by law and when, in our professional judgment, doing so is in your best interest. We will obtain your written authorization before using or disclosing your health information when authorization is required by law. You may revoke an authorization in writing, subject to applicable legal limitations. Trademark Chiropractic does not sell your protected health information.
How We May Use and Disclose Your Health Information
Treatment
We may use and disclose your health information to provide, coordinate, or manage your healthcare. For example, we may share relevant information with another healthcare professional involved in your care.
Healthcare Operations
We may use and disclose health information to operate our practice and improve the services we provide. This may include activities such as quality improvement, staff training, practice administration, compliance, and management of patient care.
Payment
We may use or disclose information when necessary to obtain or process payment for healthcare services. Trademark Chiropractic operates primarily as a self-pay practice, but certain payment-related disclosures may still be permitted or required.
Business Associates
We may use third-party service providers to perform functions on our behalf. When those service providers receive protected health information and qualify as business associates under HIPAA, they are required to appropriately safeguard that information.
When Required or Permitted by Law
We may use or disclose health information when permitted or required by law, including in circumstances involving:

We will comply with applicable federal and state privacy requirements when making these disclosures.
Substance Use Disorder Records
Trademark Chiropractic does not operate a federally assisted substance use disorder treatment program and does not provide substance use disorder treatment as a service. If Trademark Chiropractic receives or maintains records that are subject to the federal confidentiality requirements applicable to substance use disorder patient records under 42 CFR Part 2, we will handle those records in accordance with applicable federal requirements. Where applicable, additional authorization, consent, notice, or other protections may be required before those records may be used or disclosed.
Our Responsibilities
Trademark Chiropractic is required by law to maintain the privacy and security of protected health information.
We will:

Follow the duties and privacy practices described in the Notice currently in effect.

Provide you with a copy of this Notice upon request.

Notify affected individuals as required by law if a breach occurs that may have compromised the privacy or security of protected health information.

Use or disclose protected health information only as permitted or required by law or as authorized by you.

Honor applicable privacy rights and requests as required by law.
We will not retaliate against you for exercising your privacy rights or filing a privacy complaint.
Changes to This Notice
Trademark Chiropractic may change the terms of this Notice and may make revised terms applicable to health information we already maintain as well as information we receive in the future, to the extent permitted by law.
If this Notice is materially revised, the updated Notice will be made available at our clinic, upon request, and on our website.
